Consultancy on adjusting investment certificate (Updated : 06/03/2012)

When adjusting objectives, scale, location, form, capital or execution schedule of investment projects, the investors have to carry out legal procedures to adjust the investment certificate.

1. The forms of adjustment:
· Procedures for adjustment registration or adjustment examination are not required;
· Verification of adjusting investment project.
2. Receive consultative requests:
Immediately after receiving client’s requests, Vconsult lawfirm will survey and confirm the request. In this period of time, specialized part of Vconsult Lawfirm can exchange relevant information with clients via phone, email or direct communication.
3. Check and assess the lawfulness of client’s consultation requirements and documents.
- Base on the requirements and documents which clients provide, our lawyers will analyze and evaluate the legality, conformity with the requirements of the work.
- In case clients need lawyers to involve in negotiating, exchanging with the customer’s partners to change the content of investment licenses, we will arrange and ensure participation as required.
4. Responsibilities of representative.
- Conducting submit the document to change the investment license;
- keep on track the process on settling and reporting results of the submitted documents;
- Receive a certificate of investment in the Department of Planning and Investment;
- Conduct to submit the registration documents of engraving seal and contact to engrave seal for the Business (if the adjustment leads to change the legal entity’s seal);
- Receive registration certificate of seal form and sign of the company;
5. Necessary papers and information include:
- Contents require changing;
- Investment certificates (notarized copy)
- The amendment and supplement copy of the joint venture contract or business cooperation contracts or business rules;
- We represent for clients to translate and notarize the related documents.
